2. Use of the Software

You may use the Software for the purpose of managing your school/academy's operations, including but not limited to student records, attendance tracking, fee management, and communication with parents.

You agree to use the Software in accordance with all applicable laws and regulations.

You are responsible for maintaining the confidentiality of your account credentials.   

3. Data Privacy and Security

eSkoolify.com will take reasonable measures to protect the security and confidentiality of your data within the Software.

eSkoolify.com may collect and use certain information about your use of the Software, such as usage data and performance metrics. This information will be used to improve the Software and provide better service to you.

eSkoolify.com will not share your sensitive data with third parties without your prior consent, except as required by law.

You are responsible for ensuring the accuracy and completeness of the data you enter into the Software.

No Individual Backups: eSkoolify.com does not provide Individual backups of your data. You are solely responsible for maintaining your data. You can download important data in Excel/CSV or PDF format for your records. Be care when give anyon edit privileges.

4. Intellectual Property

The Software and all related intellectual property rights, including but not limited to copyrights, trademarks, and patents, are owned by eSkoolify.com or its licensors.   

You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products, or services obtained from the Software, except as expressly permitted by these Terms.   

Your Content

In these Website Standard Terms and Conditions, "Your Content" shall mean any audio, video text, images, or other material you choose to display on this Website. By displaying Your Content, you grant Eskoolify.com a non-exclusive, worldwide irrevocable, sub-licensable license to use, reproduce, adapt, publish, translate and distribute it in any and all media.

Your Content must be your own and must not be invading any third-party’s rights. Eskoolify.com reserves the right to remove any of Your Content from this Website at any time without notice.

The Company is not responsible for the content of the Service's users. You expressly understand and agree that You are solely responsible for the Content and for all activity that occurs under your account, whether done so by You or any third person using Your account.

You may not transmit any Content that is unlawful, offensive, upsetting, intended to disgust, threatening, libelous, defamatory, obscene, or otherwise objectionable. Examples of such objectionable Content include, but are not limited to, the following:

• ·        Containing or installing any viruses, worms, malware, trojan horses, or other content that is designed or intended to disrupt, damage, or limit the functioning of any software, hardware, or telecommunications equipment or to damage or obtain unauthorized access to any data or other information of a third person.
• ·        Infringing on any proprietary rights of any party, including patent, trademark, trade secret, copyright, right of publicity, or other rights.
• ·        Impersonating any person or entity including the Company and its employees or representatives.
• ·        Violating the privacy of any third person.
• ·        False information and features.

 The Company reserves the right, but not the obligation, to, in its sole discretion, determine whether or not any Content is appropriate and complies with this Terms, refuse or remove this Content. The Company further reserves the right to make formatting and edits and change the manner of any Content. The Company can also limit or revoke the use of the Service if You post such objectionable Content. As the Company cannot control all Content posted by users and/or third parties on the Service, you agree to use the Service at your own risk. You understand that by using the Service You may be exposed to content that You may find offensive, indecent, incorrect, or objectionable, and You agree that under no circumstances will the Company be liable in any way for any content, including any errors or omissions in any content, or any loss or damage of any kind incurred as a result of your use of any content.

The Software is provided "as is" and without warranty of any kind, express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.   

eSkoolify.com does not warrant that the Software will be error-free, uninterrupted, or secure.

eSkoolify.com is not responsible for any damages or losses resulting from the use or inability to use the Software.

6. Limitation of Liability

In no event shall eSkoolify.com be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data loss, or loss of business, arising out of or in connection with the use of the Software, even if eSkoolify.com has been advised of the possibility of such damages.   

Indemnification

You hereby indemnify to the fullest extent Eskoolify.com from and against any and/or all liabilities, costs, demands, causes of action, damages, and expenses arising in any way related to your breach of any of the provisions of these Terms.

7. Renewal and Pricing

Renewal costs for the Software are subject to change at eSkoolify.com's discretion. You need to check the renewal/subscription pages to check latest renewal charges. 

8. Free Trial and Refund

• Free Trial: New users are eligible for a 15-day free trial of the Software with access to all features included in the selected plan.
• Refund Policy: If, within 15 days of the initial trial period, the user is not satisfied with the Software, they may request a full refund without any questions asked. Feedback on their experience is always welcome to help us improve our services.
• Trial Offer Changes: This free trial offer may be changed or withdrawn at any time without prior notice.

9. Cancellation Policy

• Free Trial: Following the 15-day free trial period, the subscription will automatically renew on an annual basis.
• No Refunds After Trial: No refunds will be issued for cancellations made after the initial 15-day free trial period.
• Annual Subscription: After the initial trial, users will be charged an annual subscription fee.
• Automatic Renewal: Subscriptions will automatically renew annually unless canceled by the Subscriber in accordance with this section.
• Cancellation: To cancel a subscription, the Subscriber must cancel it from Subscriber's account dashboard.
• Cancellation Deadline: Cancellations must be initiated at least 3 business days prior to the next renewal date to be effective.
• No Refunds After Renewal: No refunds will be issued for cancellations made after the renewal date has commenced

10. Shipping and Delivery

As this is a software-based service, no physical products will be shipped. Upon successful payment and account approval, access to the eSkoolify.com platform will be granted within 48 business hours.

11. Fair Use Policy

Use of the Software is subject to a fair use policy. Excessive usage, as determined by eSkoolify.com in its sole discretion, may result in service limitations or account suspension.

12. File Upload Limits

There are limits on the number and size of files that can be uploaded to the Software. These limits may be subject to change at eSkoolify.com's discretion.

13. Self-Managed SaaS

The Software is a self-managed SaaS system. You are responsible for managing your own data within the Software, including adding, editing, and deleting data.

14. Email Usage Policy

1. Limited Email Storage – Each account has a maximum storage limit of 256 MB for emails. Exceeding this limit may result in the loss of emails or email account deactivation.

2. Restricted Email Usage – Emails can only be sent to staff, students, and parents within the institution. Marketing, merchandising, or promotional email campaigns are strictly prohibited.

3. No Spam Policy – Sending spam, bulk, or unauthorized emails is strictly forbidden. Any misuse may result in suspension or termination of the email service/school subscription , without notice.

4. Responsibility & Compliance – Users must regularly manage their inbox to stay within the storage limit. The institution reserves the right to monitor and enforce email policies to maintain a secure and efficient communication system.

15. SMS Usage Policy

1. Third-Party SMS Gateway Subscription – SMS services are not included in our platform by default. Users must purchase SMS credits separately from third-party providers like Twilio, Clickatell, Bulk Gateway, etc. Our platform only provides integration support for these services.

2. Restricted SMS Usage – SMS can only be sent to staff, students, and parents within the institution. Marketing, promotional, or bulk advertising SMS campaigns are strictly prohibited.

3. Anti-Spam & Anti-Scam Policy – Sending unsolicited, fraudulent, misleading, or spam messages is strictly forbidden. Any violation may result in suspension or termination of SMS functionality/School Subscription without notice.

4. User Responsibility & Compliance – Users must ensure they comply with local telecom regulations and SMS gateway provider policies when sending messages. The institution is responsible for monitoring and managing SMS usage within the provided guidelines.

16. Termination

eSkoolify.com may terminate your access to the Software at any time, with or without cause, upon prior written notice.

You may terminate your use of the Software at any time by providing written notice to eSkoolify.com.

17. Governing Law

These Terms will be governed by and interpreted in accordance with the laws of the State of West Bengal in India, and you submit to the non-exclusive jurisdiction of the state and federal courts located in India for the resolution of any disputes.

 18. Changes to These Terms

eSkoolify.com may update these Terms from time to time. You will be notified of any changes by posting the updated Terms on the Software or by other reasonable means.

Your continued use of the Software after any changes to these Terms constitutes your acceptance of the updated Terms.

Severability

If any provision of these Terms is found to be invalid under any applicable law, such provisions shall be deleted without affecting the remaining provisions herein.

Assignment

Eskoolify.com is allowed to assign, transfer, and subcontract its rights and/or obligations under these Terms without any notification. However, you are not allowed to assign, transfer, or subcontract any of your rights and/or obligations under these Terms.
